HOW TO APPEAL A YELLOW LINE COUNCIL PCN

Council PCNs for yellow line contraventions (codes 01, 02 and related) are among the most successfully challenged. The enforcement depends entirely on the Traffic Regulation Order being valid, the yellow lines being correctly painted, and the signs being compliant with the Traffic Signs Regulations and General Directions 2016 — any gap is grounds for cancellation.

LEGAL ANGLES TO USE

—Traffic Signs Regulations and General Directions 2016 (TSRGD) — yellow lines must be painted to the correct specification; kerb marks (time plates) must be present, legible, and accurately reflect the restriction
—Traffic Regulation Order (TRO) validity — the restriction must be authorised by a valid, properly-made TRO; you can request a copy from the council
—Loading exemptions — most single yellow lines permit loading and unloading; if you were actively loading, you may have a complete defence
—Procedural impropriety — the PCN must contain all mandatory information required by the Civil Enforcement of Parking Contraventions (England) Representations and Appeals Regulations 2007
—Notice to Keeper timing — if issued by post, the NtK must be served within statutory time limits

WHAT TO PHOTOGRAPH AND NOTE

✓Photograph the yellow lines and any time plates (kerb markings) showing the hours of operation

WHAT HAPPENS AFTER YOU APPEAL

The council must respond to a formal representation in writing. If they reject it, you have 28 days to appeal to the independent Traffic Penalty Tribunal (England outside London) or London Tribunals (London and TfL) — both free. A significant proportion of tribunal appeals succeed.

Does appealing a council PCN stop the charge escalating?+

Yes — while a valid representation is pending, the council cannot escalate to a Charge Certificate or instruct enforcement agents. The discount period is also suspended.

What if the council rejects my appeal?+

They must issue a Notice of Rejection and tell you about the independent tribunal (Traffic Penalty Tribunal or London Tribunals). You have 28 days to appeal to the tribunal — it's free and genuinely independent.

Can I appeal after paying?+

Generally no — payment is treated as acceptance. Always appeal before paying if you have any grounds.

Do I need a solicitor?+

No. Council PCN appeals at all stages — including the tribunal — can be handled without legal representation. The process is designed to be accessible to ordinary motorists.
