HOW TO APPEAL AN NCP PARKING TICKET

National Car Parks (NCP) is one of the UK's oldest and largest parking operators, running multi-storey and surface car parks in city centres across the country. Despite their size, their charges are still subject to POFA 2012 and the BPA Approved Operator Scheme — and they make the same procedural mistakes as any other operator.

LEGAL WEAKNESSES IN THEIR TICKETS

• —Pay-and-display machine faults — if the machine was broken, out of tickets, or not accepting payment, you cannot have formed a valid contract
• —Unclear tariff signage — pricing and terms must be displayed prominently before you commit to parking
• —POFA 2012 Notice to Keeper requirements — timing and mandatory wording
• —De minimis overstay — very short overstays (under 10 minutes) are protected by the mandatory BPA grace period

STEP-BY-STEP: HOW TO APPEAL

• —Don't pay yet. Paying is treated as accepting the charge — you lose your appeal rights. Check the ticket date and your own records first.
• —Check the Notice to Keeper timing. If your ticket was issued by ANPR camera (no windscreen ticket), the Notice to Keeper must arrive within 14 days of the parking event. A late NTK means keeper liability never arises under POFA 2012 — this alone ends the matter.
• —Photograph the location. Go back to where you were parked and photograph all signs, their positions, and any road markings. Signs must be prominently visible at the point of entry — obscured, faded, or missing signs are a strong appeal ground.
• —Submit your informal appeal in writing within 28 days of the PCN date. Be specific: cite POFA 2012, the BPA/IPC Code of Practice, and the exact weaknesses you've identified. Vague appeals are rejected.
• —If NCP rejects your appeal, they must provide a POPLA code. Use it — POPLA is free and independent. Around 40% of cases succeed at this stage.
• —If POPLA rules against you, the operator can pursue a County Court claim — but many don't. If you receive a court claim form, respond within 14 days and file a defence.

EVIDENCE TO GATHER NOW

• ✓Photos of all signs at the car park entrance and within the car park — note whether they were clearly visible and legible
• ✓The date and time the parking event occurred — compare against when the Notice to Keeper arrived
• ✓Any pay-and-display receipts, parking app confirmations, or bank transaction records
• ✓Your vehicle registration document — confirm the VRM on the PCN matches your vehicle exactly
• ✓Any correspondence from the operator — keep all letters in date order

HOW THE APPEAL PROCESS WORKS

NCP is a member of the BPA Approved Operator Scheme. All BPA members must follow the BPA Code of Practice, which sets minimum standards for signage, grace periods, and the appeal process. If NCP rejects your informal appeal, you have 28 days to escalate to POPLA — the independent adjudicator for BPA members. POPLA costs nothing and its decisions are binding on the operator. A well-argued POPLA submission succeeds in around 40% of cases.
